ROLE OF MEDIA AND BROADCASTING AGENCIES IN JUSTICE DELIVERY SYSTEM
Abstract
Media is considered to be the fourth pillar democracy. This pillar is constantly helping to achieve Justice. In the democratic setup of India, media has been a guiding force for justice delivery system of this nation. In many high profile cases, it is evident that media has contributed in getting justice. Freedom of speech and expression is one of the cardinal principles of Constitution. This very principle is protected and promoted by the Press and media. Critics often quote freedom of press and media as “Media Trail” in negative context. Media trial is not authentic, because judges after hearing entire case and after giving due recognition to evidence and facts of the case, gives final verdict. Here author is trying to convey through this paper, that press and media actually helps in getting justice and achieving the goal of fair trail which is one of hard core principle of our legal system. News agencies have wide network and they provide first hand information in many cases. Under certain circumstances it is evident that, victims out of social fear, ignorance, and poverty hesitate to report their cases, in such situation media and broad casting agencies plays pivotal role in reporting their cases. In fact in the country like India media and broadcasting agencies have played most significant role in creating balancing in society, by proving various means like reporting of facts, putting accused behind the bars, doing special and independent investigation to help the investigating agencies in getting the justice. The author in this paper is trying to lay down various positive aspects of press and media to get the justice. India is a country where, media has been always given full freedom to put forth their news before the public at large. Article 19[1], states “Everyone has the right to freedom of opinion and expression, this right includes freedom to hold opinion without interference seek and receive information on any ideas through press and media”.
